Rental terms
These terms apply to every booking of Casa Herta d'Ibiza. They are written to be read, not deciphered: where something can work against you, it says so plainly.

Who rents out the house
Casa Herta d'Ibiza is rented out by Herti BV, Albert I-Promenade 55/A9, 8400 Ostend, Belgium, company number BE 0792.689.938.
The house is at Carrer de Cala Salada, Sant Antoni de Portmany, Ibiza, and is registered under tourist licence ET-0403-E.
You rent directly from the owner. No platform, agency or middleman is involved.
What you are renting
You rent the entire villa with everything that belongs to it: five bedrooms, five bathrooms, the kitchen, the pool terrace with infinity pool and the upper terrace with jacuzzi.
The villa is let for a maximum of twelve adults. Including children, the maximum is fourteen people. Having more people stay than agreed, or using the house for a party or event, requires our written permission in advance.
Bed linen and towels, final cleaning, water, electricity, wifi and air conditioning are included. There is no additional charge for usage.
Booking and payment
A booking is final once the deposit has been paid and you have received a confirmation with a booking reference from us. Until then the dates remain available to everyone.
On booking you pay 40% of the rental price. The remaining amount, together with the security deposit, is charged automatically to the card you booked with 45 days before arrival. You receive a reminder two weeks beforehand, so it does not catch you out.
If you book within 45 days of arrival, the full amount and the security deposit are due immediately.
If the charge fails we send you a payment link and try again on three further occasions. If the balance is still outstanding fourteen days after the due date, we may cancel the booking; the deposit then remains due under the cancellation terms below.
All amounts are in euro. The rental is exempt from VAT. The Balearic tourist tax is calculated and shown separately.
The security deposit
The security deposit is ten percent of the rental price and is paid together with the balance. It is not an extra cost: you get it back.
Within three working days of your departure we return it to the same card. If something is damaged or missing, we tell you first — with photographs and a statement of the cost — before withholding anything.
We never charge for normal wear and tear. A broken glass is normal wear and tear.
Cancellation
Cancel in writing, by email to info@casaherta.com. The date your email reaches us is the one that counts.
More than 60 days before arrival: free of charge. Everything you have paid is returned.
Between 60 and 45 days before arrival: the 40% deposit remains due. We ask for nothing more.
Less than 45 days before arrival: the full rental price remains due. The security deposit is of course returned.
If we manage to let the freed-up period after all, we refund what we receive for it, up to what you paid. The law does not require this of us; we simply do not think it right to be paid twice for the same week.
If we have to cancel — through damage, force majeure or anything else beyond our control — you get back everything you have paid and we help you look for an alternative. Further compensation is excluded.
Cancellation insurance is not included. For anyone booking far ahead, it is worth considering.
Arrival and departure
You can check in from 4 pm on the day of arrival. On the day of departure we ask you to leave by 10 am, so there is time to prepare the house for the next guests.
If you will arrive later than 9 pm, let us know in advance and we will make sure someone is there.

During your stay
The house stands in a residential area, among other houses. We therefore ask for quiet between 11 pm and 8 am, and no amplified music outdoors.
Smoking is fine outside, not indoors. Pets are welcome if agreed in advance.
The pool is unfenced and unsupervised. Children remain under the supervision of the adults in the party. Swimming is at your own risk.
If something is not right, call us during your stay rather than reporting it afterwards. Almost everything can be fixed while you are still there.
Legal registration of travellers
Spanish law requires us to report a number of details for every traveller to the authorities: name, date of birth, nationality, identity document and the details of the stay. This includes children.
About thirty days before arrival we ask you to enter these details through your own booking page. Without them we cannot register your stay and cannot hand over the keys.

Tourist tax
The Balearic Islands levy a tourist tax per person per night. Children under sixteen are exempt. From the ninth consecutive night the rate is halved.
We include the tax in your total and always show it as a separate line, so you can see what goes to the government and what goes to us.
Damage and liability
You are responsible for damage caused by you or your party during the stay. Report damage straight away; it makes things simpler for everyone.
We are not liable for the loss or theft of personal belongings, for accidents in or around the house, or for the temporary failure of water, electricity or internet through no fault of ours. We will of course do what we can to resolve it quickly.
Nothing in these terms limits our liability for intent, gross negligence, or harm to life or health.
Complaints and applicable law
If you are unhappy about something, tell us first — preferably during your stay, and otherwise within fourteen days of departure. We answer every complaint.
Belgian law applies to this agreement, without prejudice to the mandatory consumer protection of the country where you live. Disputes we cannot resolve together are submitted to the competent court in Ostend, or to the court of your place of residence where you are entitled to that as a consumer.
